Регулярно создаются новые сайты, призванные привлечь внимание как можно большего числа людей. Интернет является одним из наиболее эффективных каналов для передачи данных. По ряду показателей глобальная сеть превосходит привычные всем средства массовой информации. Все это можно объяснить нехваткой у граждан времени на просмотр новостных передач по ТВ и чтение прессы. Большинству людей проще и удобнее зайти на определенный сайт в интернете и просмотреть там свежие новости.
Пока что зарегистрировать сайт в качестве средства массовой информации можно добровольно. Три года назад был принят закон, согласно которому интернет-ресурсы с числом посетителей более 1000 в сутки нужно регистрировать. Однако этот законопроект в жизнь воплощен не был. Госдума начала осуществлять контроль над сайтами иными способами. Давайте рассмотрим основные достоинства и недостатки регистрации интернет-ресурса в качестве СМИ.
Преимущества для сайтов СМИ
Деятельность интернет-ресурсов, зарегистрированных в качестве средств массовой информации, регулируется законом «О СМИ». Какие же преимущества дает регистрация сайта в качестве СМИ?
- Освобождение от ответственности (статья 57).
- Возможность направления редакционных запросов. Согласно закону, редакция любого зарегистрированного средства массовой информации может направлять редакционные запросы. Ответ на них должен быть дан не позднее, чем через 7 дней. Обычное же обращение рассматривается целый месяц. Это очень долгий срок, так как информация может быстро устаревать. Именно поэтому редакционный запрос гораздо лучше обычного обращения.
- Возможность избежать ответственности. Пожалуй, это преимущество является самым существенным. Согласно вышеупомянутому закону, в конкретных ситуациях СМИ сможет избежать ответственности при нарушении прав третьих лиц. Все эти ситуации перечислены в статье 57 закона о СМИ. Например, средство массовой информации сможет избежать ответственности за информацию, содержащуюся в интервью, размещенных без предварительной модерации комментариях и т.д.
- Статус журналистов. Сотрудники сайта, занимающиеся подготовкой и написанием контента для наполнения ресурса, зарегистрированного в качестве СМИ, получат статус журналиста. Они будут обладать правами, перечисленными в статье 47 закона «О СМИ».
- Возможность проведения аккредитации. Все СМИ имеют возможность аккредитировать журналистов, что дает им дополнительные права. Зарегистрированным сетевым изданиям также доступна возможность получения их сотрудниками аккредитации.
Регистрация СМИ нужна не только редакции, имеющей свои онлайн-ресурсы. Владельцам интернет-проектов также может быть интересно такое предложение. Конечно, чаще всего владельцам сайтов не требуются предоставляемые законом о средствах массовой информации гарантии. Однако они могут воспользоваться другими преимуществами, если решат зарегистрировать свой ресурс.
Преимущества для онлайн-проектов
- Защита названия. Далеко не все названия ресурсов защищаются авторским правом, а только те, которые обладают какой-либо особенностью. Если у вашего ресурса есть оригинальное название, проходить процедуру регистрации необязательно. Однако в сети все равно со временем может появиться проект, имеющий аналогичное название. В итоге может возникнуть спор, кто из владельцев сайтов придумал его первым. Избежать таких споров можно, зарегистрировав сайт в качестве средства массовой информации. При этом название СМИ должно соответствовать наименованию интернет-ресурса. Сайты, не имеющие оригинального названия, также желательно регистрировать. Это поможет им защитить свои права.
- Перспектива на будущее. Вполне возможно, что в скором времени государство решить сделать регистрацию интернет-ресурсов обязательной. Тем более, сегодня наша власть активно стремится урегулировать все, что происходит в глобальной сети. Когда регистрация интернет-ресурсов будет обязательной процедурой, зарегистрировать уже имеющееся наименование СМИ будет невозможно. Это станет большой проблемой как для региональных, так и для местных СМИ. Когда они попытаются зарегистрировать онлайн-версии, у них могут возникнуть проблемы, связанные с идентичностью названий. В этом случае подходящее название сможет зарегистрировать только один владелец, который сделает это раньше всех.

Три года назад в законе появилось новое понятие «блогер». Для него был перечислен ряд обязанностей, например, отвечать за все содержимое интернет-ресурса. Это касается даже комментариев пользователей. Таким образом, редакции онлайн-СМИ получают большое преимущество, в отличие от владельцев не зарегистрированных интернет-ресурсов. Однако все далеко не так. Подробная информация о процедуре представлена на официальном сайте Роскомнадзора, который занимается непосредственно регистрацией интернет-ресурсов.
- Необходимость оплаты пошлины. Стоимость пошлины за регистрацию ресурса в качестве средства массовой информации составляет 6 000 рублей. Если сайт имеет хорошую посещаемость и соответствующий доход, необходимость оплаты пошлины в таком размере не станет проблемой.
